During the use of the Services, You enjoy only the right to use the software solution for a single online store for the entire duration of the Services and worldwide. Notwithstanding the foregoing, the technical assistance is only provided to You as long as Your paid version of the software solution is covered by an active support plan. Similarly, the modules, themes and third party products developed either by Artetics.com or its partners remain the sole property of their owners. For these modules, themes and third party products, Artetics.com grants You simple usage rights restricted to the use of a single online store for the legal duration of the copyright and worldwide starting from the date of the order for the module, theme or third party products concerned.

Any texts, photos, videos, data, logos, brands and other elements posted on the Artetics.com website are reserved and protected by intellectual property rights, in particular copyrights, related rights, trademark rights and by legislation concerning the protection of personal data. Limitation of liability

YOU ACKNOWLEDGE AND AGREE THAT ARTETICS.COM, ITS AGENTS, EXECUTIVE, OR EMPLOYEES SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, SPECIAL, CONSEQUENTIAL DAMAGES OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES EVEN IF ARTETICS.COM, ITS AGENTS, EXECUTIVE, OR EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification of Artetics.com

You hereby agree to defend, indemnify and hold Artetics.com and its partners and the respective directors, officers, employees and agents of each harmless from and against any and all claims, losses, damages, liabilities and costs (including, without limitation, reasonable attorneys" fees and court costs) arising out of or relating to Your breach of any of these Terms or Use, except to the extent the foregoing directly result from Artetics.com"s own gross negligence or willful misconduct. THIS FOREGOING INDEMNIFICATION WILL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT OR YOUR USE OF THE SERVICES.

Miscellaneous

-Sub-contracting of the Services

Artetics.com is authorized to use the services of one or more sub-contractors of its choice to carry out all or part of the Services without giving You prior notification.

In any case, while Artetics.com shall remain bound to ensure that the sub-contractor complies with the obligations of the Terms of Use, it does not grant You any other obligations or guarantees.

-Force Majeure

Artetics.com will have no liability to You or any third party for any failure by Artetics.com to perform its obligations under this Agreement in the event that such non-performance arises as a result of the occurrence of an event beyond the reasonable control of Artetics.com, including without limitation an act of war or terrorism, natural disaster, failure of electricity supply, riot, civil disorder, or civil commotion or other event of force majeure.

-Independent Contractors

No agency, partnership, joint venture or employment is created as a result of this Agreement, and You do not have any authority of any kind to bind Artetics.com in any respect whatsoever.

-Waiver

The failure of Artetics.com to exercise or enforce any right or provision of these Terms or this Agreement will not constitute a waiver of such right or provision.

-Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.

-Assignment

You may not assign this Agreement without the prior written consent of Artetics.com, which Artetics.com may refuse in its sole discretion. Any attempt by You to assign this Agreement without prior written consent from Artetics.com will be deemed null and void. Artetics.com may assign this Agreement at any time. Subject to the foregoing, this Agreement will bind and inure to the benefit of the Parties, their respective successors and permitted assigns.

-Applicable law - Assignment of Jurisdiction

The terms and conditions contained within this agreement will be governed by the laws of the state of Texas, United States of America.

"Support" is an after-sales service provided by Artetics.com in solving software conflicts and usability problems, and in supplying updates and patches for bugs and security holes in the program.

Support is limited to:

  • Support is offered in English ONLY
  • Technical help/advice regarding our subscriptions and services
  • Technical help/advice regarding the use of our products
  • Non-documented issues, tips, and tricks regarding our software.

Support does not include:

  • Alteration or modifications of our products or any other products (Joomla! related or unrelated) to meet a certain need. You can purchase premium support in such a case.
  • PHP or any other server-side programming language training
  • SQL or any other database language training
  • Javascript or any other client-side programming language training
  • CSS or HTML training

If you wish to modify our products, you are free to do so under the GNU/GPL license. However, we offer no support for any software product that has been modified or customized.

We give and expect common courtesy during the application of the support policy. Any foul language will not be tolerated, be it from Artetics.com or from the person requesting the service.

How To Obtain Support?

Support is provided via our Support Ticket system. Any other means of communication are not endorsed unless expressly implied. We offer no support via email or otherwise for installation, customization, administration of Joomla! or any other inquiries not directly related to our products.

Obtaining Paid Support for Customizations

If you wish to consult with our engineering team about custom modifications to any of our products, please visit https://www.artetics.com/custom-development.

Support Period

Artetics.com is not obligated to provide support, access to downloads or any other services being offered in the subscription beyond the end of the term indicated by your subscription unless you renew your subscription on or before the expiration date by agreement between Artetics.com and you.

The "lifetime" of an Artetics.com product is defined by the time in which the product is "active". Products are considered "active" when they are being developed and updated to keep track with the current versions of Joomla!. Artetics.com is not obligated to provide support for "end of life" products.

Subscription expiration implies the termination of the support, update (membership details and product source code) and other download specific services.

Product Updates

All of the products are designed for the latest version of Joomla!, but we can give no guarantee, that the products will run with future versions of Joomla!.

Subscribers may use any of the endorsed methods of communication to address any issues related to software versions.

During the subscription time, we do not guarantee any new updates nor do we provide any deadlines or development paths for updates. Update deadlines and development paths are for the private use of Artetics.com only and will not be released to the public unless otherwise stated.

However, we do commit to providing a good service for our subscribers and we will do our best to ensure that our products are up to date and functional.

Updates and Changes

The Artetics.com Support Policies may be updated from time to time and are subject to change at Artetics.com's discretion. We reserve the right to modify the Support Policy at any point without prior notice.

Even though this Support Policy is effective for subscribers only, we reserve the right to apply all or any portion of it to non-subscribers.

Artetics.com is committed to developing and supporting the best quality products and we want to stand behind our products by providing a full refund of your purchase within the first 14 days if the following terms are met.

We do issue refunds if:

  • The refund is requested within 14 days since the date of your purchase.
  • You have allowed us to try and help you solve any problem you have by opening a support ticket.
  • We aren't able to help you and the reason you're requesting a refund meets the points in the below "We do not issue refunds if" section.

We do not issue refunds if:

  • Refunds are strictly only applicable to new purchases
  • If you are already using our product and decide to renew or upgrade then you are already satisfied with the product.
  • Your refund request was made after 14 days of your purchase
  • Your account is suspected of abusing our refund policy
  • If your account is flagged abusive by our fraud system, we reserve the rights to reject your refund request
  • You decide that "your software is not what I need"
  • You experience unforeseen compatibility issues with your Joomla website or script conflicts with other 3rd party software connected or installed on your Joomla website and you don't give our support team a chance to help out on any issues you might have.

Finding a bug in our products is not a reason for a refund. If you do find bugs, please report them so that we can fix them.

How refunds are issued

All refunds will be processed through the payment gateway that was used for the original purchase. Payment will not be refunded through any other payment gateway. Refunds could take up to 15 days to process.

Every Joomla Extension, Module, and Plugin produced by Artetics.com is released under the GNU General Public License, version 2 (http://www.gnu.org/licenses/gpl-2.0.html). Specifically, the PHP code in Artetics.com products is distributed under the GPL license. The products are distributed in the hope that they will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE. Please read the complete GNU General Public License for more details.

If not otherwise stated, all images, manuals, cascading style sheets (CSS), and including JavaScript files are NOT GPL and is released under the Artetics.com Proprietary Use License (See below) unless specifically authorized by Artetics.com. Elements of the extensions released under this proprietary license may not be redistributed or repackaged for use other than those allowed by the Terms of Service.

Proprietary Use License

The Artetics.com Proprietary Use License covers any images, cascading stylesheets, manuals and JavaScript files in any extensions produced and/or distributed by Artetics.com. These files are the proprietary intellectual property of Artetics.com, copyrighted and cannot be redistributed in any form without prior permission from Artetics.com.

Usage Terms

The grant to use the products on more than one domain is allowed and there are no restrictions placed. However, we provide support only for the domain(s) that you have pre-registered with us, for the length of your subscription that you have purchased. When you post a support ticket request through our online support system, it will track if you have an active license.

Limitations

Licensed domain(s) are required in order to obtain any form of technical support from Artetics.com.
